Terms & Conditions

These Terms & Conditions govern your use of EmeraldWings, a web application for managing pigeon lofts, pedigrees, race results, breeding, nutrition and health records. The service is provided by EmeraldWings ("EmeraldWings", "we", "us"). By creating an account or continuing to use the service, you agree to these terms. If you do not agree, do not use the service.

1. Your account

You must be of legal age in your country, or have authority to bind the organisation you represent. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate account information and keep it up to date.

2. Licence and permitted use

We grant you a limited, non-exclusive, non-transferable right to use EmeraldWings within the plan you have selected, for managing your own loft data. You may not:

• use the service unlawfully, fraudulently, or to send spam;
• infringe anyone's intellectual property or privacy rights;
• interfere with the security or integrity of the service — including malware, probing, penetration testing, scraping or automated bulk extraction of data;
• reverse engineer, resell, redistribute, or circumvent plan limits or technical controls.

3. Your loft data

You keep ownership of the pigeon, race, breeding and health records you enter. You grant us a limited licence to host and process that content solely to operate the service for you. Your records are isolated to your account and are not visible to other users.

4. Intellectual property

EmeraldWings retains all rights in the software, pedigree layouts, documentation, design and branding. Nothing in these terms transfers ownership of the service to you.

5. Service availability

We work to keep EmeraldWings reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages and upstream failures can interrupt access. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

6. Plans, payment and subscription terms

EmeraldWings offers a free Hobby plan and paid Amateur and Pro Racer plans, billed monthly or annually in euro. Paid plans renew automatically at the end of each billing period until cancelled. Payment, billing, currency, tax, invoicing, cancellation and refund mechanics are handled by Paddle and are governed by the Paddle Checkout Buyer Terms. You can cancel at any time from the billing page; access to paid features continues until the end of the period you have already paid for.

7. Order process and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time from the settings page. On termination you may export your data during a reasonable window; afterwards your records are deleted.

9. Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude indirect, consequential and special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury caused by negligence. You indemnify us against claims arising from your content, your unlawful use, or your breach of these terms.

10. General

These terms are governed by the laws of Portugal, and the Portuguese courts have jurisdiction. You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will publish the revised version on this page.
